By creating an account, accessing, or using Quoti (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and others who deal with the Service ("Users," "You," or "Your").
Quoti is a software-as-a-service (SaaS) platform designed to help service-based businesses manage their operations. Features include, but are not limited to, online booking, quote generation, scheduling, invoicing, client management ("Client Hub"), and automated communications (SMS/Email).
We offer different subscription plans on a weekly, monthly, or annual basis. Access to specific features depends on the plan you select. Plans and pricing are displayed within the app and on our website before purchase.
To use the Service, you must register for an account. By registering, you agree that:
If you register for a free trial, you will not be charged until the trial period expires. If you do not cancel before the trial ends, you will be automatically charged the subscription fee for the plan you selected.
We use a third-party payment processor (Stripe) to handle secure payments. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually) according to your selected plan.
You may cancel your subscription at any time via the "Billing" or "Settings" section of your dashboard.
If you subscribe to Quoti through our mobile application on the Apple App Store or Google Play Store, the following terms apply in addition to the billing terms above.
When you purchase a subscription within our mobile app, your payment is processed by Apple or Google, not by Stripe. Your purchase is subject to the applicable app store's terms and payment policies. We do not have access to or store your full payment card details for in-app purchases.
Quoti offers auto-renewable subscriptions, including a weekly plan and a monthly plan. The price and billing period of each plan are displayed on the subscription screen within the app before you confirm your purchase. Prices are charged in the currency shown at the point of purchase.
If your subscription includes a free trial, you will not be charged during the trial period. Payment will be charged to your Apple or Google account at the confirmation of purchase, after the free trial ends, unless you cancel at least 24 hours before the end of the trial period. Any unused portion of a free trial is forfeited when you purchase a subscription.
Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
You can manage or cancel your subscription at any time through your account settings in the App Store (iOS) or Google Play Store (Android). Deleting the app does not cancel your subscription. To avoid being charged, you must cancel at least 24 hours before your current period or free trial ends. Cancellation takes effect at the end of the current billing period, and you will retain access until then.
Refund requests for purchases made through the Apple App Store or Google Play Store are handled by Apple or Google according to their respective policies, and not by Quoti directly.
Our Service allows you to send emails and SMS text messages (e.g., "On My Way" alerts, Quote Follow-ups) to your end-clients.
By using these features, you represent and warrant that:
"User Content" refers to the data you input into the Service (e.g., client lists, job addresses, service pricing, company logos).
You agree not to use the Service to:
Our Service utilizes third-party services, including but not limited to Google Maps (for GPS/Routing) and Stripe (for payments). Your use of these features is also subject to the Terms of Service of those third-party providers.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THE SERVICE, THE ACCURACY OF MAP DATA, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUOTI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS REVENUE.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
Practical Translation: If our server goes down and you miss a booking, we are not liable for the lost income of that job.
We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms (e.g., missed payments, using the SMS feature for spam).
These Terms shall be governed by and construed in accordance with the laws of Québec, Canada, without regard to its conflict of law provisions.
